«Подвійні стандарти» тимчасового захисту втікачів від війни в Україні у міграційні політиці ЄС

У статті розглядається міграційна політика ЄС після повномасштабного вторгнення РФ в Україну з огляду на обвинувачення в застосуванні подвійних стандартів. Показано відмінності у можливостях для втікачів з України та інших держав, зокрема Африки та Близького Сходу. Крім правового статусу біженця (чи шукача притулку), який можуть отримувати особи, що виїхали з будь-якої країни до ЄС через небезпеку для життя, здійснено аналіз тимчасового захисту переміщених осіб, запровадженого для українців Імплементаційним рішення Ради 2022/382. Автор пояснює суть явища подвійних стандартів як суб’єктивної категорії та конкретизує передумови для скарг на їх застосування у міжнародних відносинах. Обґрунтовано, що такі скарги можуть бути наслідком або недостатньої правової обізнаності, або применшенням ролі національних інтересів держав, або констатуванням фактів порушень прав людини.
Результати дослідження дозволять протистояти маніпулятивним впливам через кліше «подвійний стандарт» ефективніше, а також здійснювати більш зважену міграційну політику з врахуванням принципу недискримінації.
